This MosaicEarth Standard License (“License”) governs the use of a geospatial asset obtained through MosaicEarth under the MosaicEarth Standard License. The person or entity that publishes and licenses the asset is the Licensor. The person or entity that lawfully acquires it through MosaicEarth is the Licensee.
1. License grant
Subject to compliance with this License, the Licensor grants the Licensee a worldwide, perpetual, non-exclusive, royalty-free licence to use the acquired asset for personal and commercial purposes.
The Licensee may reproduce, modify, edit, crop, transform, simplify, optimise, adapt or convert the asset; combine it with other data or content; create derivative works; and use it for visualisation, mapping, GIS, analysis, research, simulation, websites, applications, games, virtual environments, audiovisual works, renders, physical products and professional client work.
Products or services incorporating the asset may be sold or distributed provided the asset itself is not distributed or made available as a standalone or reasonably extractable asset. No additional royalties are payable for permitted uses after lawful acquisition.
2. Redistribution and resale restrictions
The Licensee may not resell or redistribute the original asset; make it available for download by third parties; sublicense it as an independent asset; publish it to another asset marketplace, stock library or repository; or redistribute a converted, repackaged, optimised or modified version that remains substantially equivalent to the acquired asset.
Modifications must not be used primarily to circumvent these restrictions, and the Licensee must not claim authorship or ownership of the original. A broader derivative product may be distributed when the asset cannot reasonably be extracted and reused as an independent substitute for the original.
3. Ownership
Ownership and applicable intellectual-property rights in the original asset remain with the Licensor. Acquisition does not transfer ownership. The Licensee retains any independent rights in their original contributions to derivative works without acquiring ownership of the underlying asset.
4. Attribution
Attribution to the Licensor is appreciated but is not required under this License. MosaicEarth may display creator and provenance information. This does not remove attribution or other obligations imposed by applicable law or valid third-party rights incorporated by the Licensor.
5. Licensor rights and third-party content
The Licensor represents that they own or control the rights needed to publish and license the asset. They must not offer an asset where third-party terms prevent these permissions. This License does not override copyright, database, trademark, privacy, property or other third-party rights.
6. Professional and commercial use
Subject to Section 2, permitted uses include GIS and geospatial analysis, cartography, surveying-related workflows, architecture and engineering visualisation, research and education, games, XR, simulations, digital twins, film, websites, applications, presentations, publications, commercial services and client products. The Licensee must determine whether the asset has sufficient accuracy, quality and legal suitability.
7. No warranty
Unless expressly stated otherwise, assets are provided “as is” and “as available”. Neither the Licensor nor MosaicEarth guarantees completeness, absence of error, continuous availability, a particular accuracy, fitness for purpose, safety-critical suitability, legal or cadastral suitability, or compatibility with particular software. Technical metadata is informational unless expressly guaranteed by contract.
8. Liability
To the maximum extent permitted by law, neither the Licensor nor MosaicEarth is liable for indirect, incidental, special or consequential damage from use or inability to use an asset. The Licensee is responsible for evaluating suitability. Nothing excludes liability that cannot lawfully be excluded.
9. Duration and termination
The License is perpetual unless terminated for the Licensee's material breach. Where a breach can be remedied, reasonable notice and an opportunity to remedy should be provided where required or appropriate. After valid termination for an uncured breach, unauthorised use and redistribution must stop. Final products lawfully created and distributed before termination are not automatically withdrawn unless required by law or a competent authority.
10. License version
The version applicable at the time of acquisition governs that acquisition. Later versions do not retroactively change rights already granted. MosaicEarth may retain records identifying the asset, acquisition, licence and version.
11. Relationship with MosaicEarth
MosaicEarth operates the platform through which assets are published, discovered, acquired, visualised and delivered. Unless identified as the Licensor, MosaicEarth does not own or license the asset. The Licensor is responsible for their rights. Platform use is also subject to the Terms of Service.
12. Governing law and disputes
This License is governed by the law and dispute provisions in the MosaicEarth Terms of Service applicable to the acquisition.
13. Entire license
This License defines the standard rights granted for an asset acquired under it. An additional restriction displayed by a Licensor does not modify this License unless MosaicEarth expressly supports and records it as part of the acquisition. If a provision is unenforceable, the remaining provisions continue to the maximum extent permitted by law.
